Smoking.fr understands that you may wish to be informed about how we process data and information that could personally identify you, such as your name, address, phone and fax numbers, or email address, etc. ("Personal Data") that you provide to SMOKING.FR. We have therefore developed this policy to explain how we use your Personal Data, as well as all the reasonable precautions we take to ensure transparency, confidentiality, security, and controlled access.

The entity responsible for the collection and processing of data on the website SMOKING.FR is SARL PROJECT WEB, with a capital of 15,000 euros, located at 235 allée Hector Pintus - 06610 La Gaude, France, registered with the Grasse Trade and Companies Register under number 499 389 146, represented by Mr. Romain GOUNIOT, its Managing Director and Data Protection Officer.

1. What data does SMOKING collect?

Smoking.fr does not collect or process any Personal Data that you have not specifically, voluntarily, and knowingly provided to us. We guarantee that our staff adheres to strict security and confidentiality standards and assure you that the processing of your Personal Data is carried out in full compliance with recognized data protection laws.

Personal Data is any information that allows you to be identified directly or indirectly, including, but not limited to, your last name, first name(s), date of birth, mailing address, email address, or phone number.

2. Why does SMOKING collect and process your data?

SMOKING does not retain your data longer than necessary.

The retention period depends on the service to which the data relates and, in any case, lasts for the duration of the business relationship and/or as required for tax, accounting, resolving potential disputes, debt collection needs, criminal activity, and to prevent potential unlawful conduct, to conduct satisfaction surveys, and to ensure the compliance of our records.

This data collection is carried out in compliance with the law, prior notifications filed with the CNIL, and the GDPR, regarding customers and prospects. We do not collect unnecessary data or data in excessive quantities.

The Data is also subject to duly declared interim archiving to meet legal, accounting, and tax obligations.

Web push notifications:
We provide news and updates on our websites via web push notifications. To use this free service, operated in partnership with our push notification provider "WonderPush," you must first subscribe by clicking on a permission request controlled by your browser and device when you visit our site.

The browsing data we may store and process to operate this service and send you relevant messages is anonymized, retained on WonderPush's servers for up to 90 days, and is never shared with third parties. We do not store any personally identifiable information or IP addresses associated with you or your device as part of the push notification service.

3. Who has access to your data?

Smoking.fr never sells, rents, shares, or discloses your Personal Data to third parties outside of SMOKING.FR for commercial purposes in any way.

The data collected is intended for the internal departments of SMOKING and its subcontractors to support the provision of Services, including trusted third parties for credit card payments, web hosting providers, specialized fraud detection service providers, carriers, and authentication services: OVH, Scalapay, a trusted third party for credit card payments, PayPal, and carriers.

If required by law, the site may disclose data to address any complaints and comply with administrative and judicial procedures

In any event, SMOKING.FR ensures that these third parties guarantee the same level of protection as the Site itself and, if necessary, SMOKING.FR requires a contractual guarantee that these third parties will process Personal Data exclusively for the purpose authorized by you, with all necessary discretion and security.


4. Is your data processed outside the EU?

The visitor/Customer authorizes the Site to transfer, store, and process their information within the European Union.

The data collected may be processed outside the European Union by hosting and payment service providers. In this case, SMOKING takes the necessary measures with its subcontractors and partners to ensure an adequate level of protection for your data, in full compliance with applicable regulations.

In any event, the website remains responsible. Such transfers are governed by organizational and technical measures designed to ensure an adequate level of protection for the data in question.

5. Commitment to Security and Confidentiality

We take the security of your data as seriously as we do our own. The data collected is stored in a secure environment inaccessible to the public to prevent any unauthorized access, use, loss, alteration, destruction, or disclosure.

SMOKING is committed to implementing and maintaining, at its own expense, an appropriate IT security program that takes into account the state of the art, implementation costs, and the nature, scope, context, and purposes of the processing of personal data, as well as the risk (of varying probability and severity) to the rights and freedoms of visitors/Customers. This program includes rigorous technical and organizational measures. Only individuals who are authorized and empowered to process your data within SMOKING and its partners (qualified staff, hosting provider) have secure access to it.

Technical and organizational measures may benefit from technological advancements and future developments. Consequently, SMOKING is authorized to use any appropriate alternative measures in this regard. Most of the information we collect on our websites is anonymous. When you visit our websites, we do not collect any Personal Data that is not specifically, voluntarily, and knowingly provided by you. This anonymous information is processed by SMOKING to help improve the content of its websites, to personalize them for our visitors, and to learn more about them and how they use these websites.
